Meeting Held to Facilitate Enforcement

On the afternoon of 11 May 2018, Haikou Maritime Court held a meeting to discuss enforcement practices and seek solutions for difficulties encountered in enforcement.

The meeting also reviewed the court’s main achievements in basically resolving difficulties in enforcement since 2016, and analyzed the shortcomings and weaknesses in our current practices.

The following requirements were made at the meeting:

First, to fully understand the imminence of basically resolving difficulties in enforcement and be more aware of the challenges. It was important to follow established plans in working and supervising, and to assign specific tasks to dedicated personnel. Specific work descriptions, measures and time limits would help facilitate and accelerate enforcement.

Second, to put in place dedicated personnel and equipment for enforcement. The composition of the enforcement personnel should be scientifically optimal and up to the standards for enforcement practices and third-party assessments and examinations. It was also important to further regulate the conclusion procedures for cases in which no assets were available for enforcement, and to strengthen the enforcement of cases in which assets were available for enforcement.

Third, to be bold and firm in persistently cracking down on deadbeats. Good communication and coordination should be maintained to facilitate joint enforcement actions against crimes. A problem-oriented attitude should be adopted, and efforts should be made to straighten out the process for transferring enforcement cases to bankruptcy procedures in order to solve cases for which enforcement was not possible.

Fourth, to focus on the front line and join internal forces to tackle difficulties in enforcement; to increase promotion of enforcement and enhance liaison with NPC representatives in order to break new ground for maritime enforcement with characteristics.

It was stressed at the meeting that the battle against difficulties in enforcement had been in the heat. All of the judges, court staff, and judicial personnel had to unify their thinking, understand the situation, and improve their political awareness. It was important to raise the “four senses of awareness” and be firm in the “four beliefs”. No costs should be spared in wining the battle against difficulties in enforcement with determination and faith. It was also important to take firmer leadership and management to further our progress in this battle. The whole court would work together, and stronger support would be provided in terms of personnel, finance and equipment. Works should be done against standards and indexes in preparation for assessments. High standards and strict requirements should be kept, errors should be minimized, and self-examination and correction should be conducted prior to third-party assessments. We should also keep innovative thinking and have timely promotion of the highlights at our works. This would contribute to the overall enforcement practices of the court. We should also regulate management and ensure impartiality and integrity in order to keep an enforcement team of honor and accountability. Careful supervision should be kept to identify and regulate risks in enforcement practices. Efforts should be made to ensure that the enforcement team was integral and law enforcement was conducted in a civilized manner.
