In recent days, officers from the Enforcement Bureau of Haikou Maritime Court rushed to Jinjiang, Fujian and successfully arrested a vessel owned by the judgment debtors in a case of dispute over liability for personal injury at sea. The judgment debtors were thus compelled to fulfil their obligation to make compensation.

In this case, Haikou Maritime Court had ordered the two judgment debtors to jointly and severally compensate the enforcement applicant, Guo, a sum of CNY 394542.42 for medical costs, disability compensation, and assessment fees etc. The judgment debtors had defaulted on the payment after the judgment took effect, and the enforcement applicant, Guo, applied to Haikou Maritime Court for enforcement. The court entertained the case on the same day of the application. During the enforcement, the parties reached an agreement on the sum and time of payment. However, the judgment debtors went back on their words and the agreement was not fulfilled. As a result, the enforcement applicant was unable to afford subsequent medical treatment.

To protect the lawful rights and interests of the enforcement applicant under this stressed situation, the enforcement officers made greater efforts to track the judgment debtors’ assets. Eventually in late April, a vessel owned by the judgment debtors was spotted in the waters in Jinjiang, Fujian. The enforcement officers gave up their weekend and stayed watching for three days before they finally arrested the vessel at Anping Terminal, Jinjiang. Under great pressure, the judgment debtors took the initiative to contact the enforcement applicant. They then reached a reconciliation agreement and fulfilled it on the spot.

The case, which concerned people’s livelihood, was thus successfully concluded and the fees for subsequent medical treatment for the enforcement applicant were assured. The same night after getting the compensation, the enforcement applicant called to thank the enforcement judge and showed great appreciation of the judge’s persistence and dedication to serving the people.
