Recently, the Enforcement Bureau of our court has assisted the People’s Court of Huaiyuan County, Anhui Province with enforcement in a private loan dispute case. We assisted the nonlocal court in taking the judgment debtor into custody, and further helped to bring about the settlement between the litigant parties. This has effectively protected the parties’ lawful rights and interests.
On 3 March 2017, the People’s Court of Huaiyuan County, Anhai Province sent a delegate to our court and entrusted us with arresting a cargo ship in Haikou owned by a judgment debtor in a case of private loan dispute. Our Enforcement Bureau paid high attention to the request and delegated a senior enforcement judge for assistance. We located the ship and the judgment debtor in no time, and made necessary preparations for arresting the ship. Then the enforcement judge hurried to the site, inspected the condition of the ship and grasped the financial position of the judgment debtor. Through investigation, the judge was acute to learn that the judgment debtor was solvent to a certain extent, and that arresting and disposing of the ship would on the contrary hinder the efficiency of enforcement. After obtaining the consent of the entrusting court, we decided not to arrest the ship, and instead dispatched judicial policemen to assist in taking judicial custody of the judgment debtor. Under the great pressure of enforcement, the judgment debtor deeply regretted his wilful evasion of repayment while he was in custody. His family soon paid the debts in partial and offered a guarantee of the balance along with a settlement plan. Such acts won the recognition of the judgment creditor. As the judgment debtor had realized and regretted his fault, the entrusting court released him prematurely on 7 March, and a settlement was reached in the case.
